지난 11일 NK뉴스(NKnews.org)와 미국의 소리(VOA) 방송은, 북한과 러시아가 지난 9월 불법 체류자나 탈북자를 강제송환하는 데 합의했다고 보도했다.

보도에 따르면, 북-러 양국 간 합의된 협정은 적법한 서류를 소지하지 않고 체류하다 적발된 사람은 구금되고, 이후 인터뷰를 거쳐 불법 입국 사실이 확인될 경우 30일 내에 본국으로 송환된다는 내용을 주요 골자로 하고 있다.

보도 이후, 러시아가 중국과 같이 자국내 불법체류중인 탈북자들을 검거해 강제 북송할 것이라는 추측이 제기되면서, 러시아 내 탈북자들의 신변이 극도로 위험해 질 것이라는 우려가 팽배해졌다. 그러나 다행스럽게도 본의원실이 파악한 결과 이는 기우인 것으로 밝혀졌다.

김정은의 특사 자격으로 최룡해 노동당 비서가 방러중임에도 불구하고, 러시아측은 탈북자 강제북송은 없다고 본의원실에 공식 답변을 보내왔다.

러시아대사관은 “해당 협정은 외국인의 입·출국 및 체류에 관한 해당국의 법규를 위반한 개인들의 입국승인(admission)과 이동(transfer)을 다루는 것으로 협정 체결일자는 아직 결정되지 않았다”며 “북한난민들이 러시아 영토로부터 북한으로 송환된 사례는 과거 수년간 없었고, 북한주민이 제3국행을 희망할 시에는 인도주의 정신과 인권에 대한 존중에 입각해 UN난민고등판무소(UNHCR)의 절차에 따르도록 돼있다”고 밝혔다. (자료 첨부)

본의원은 인도주의 정신과 UN기구의 절차에 따라 자국내 탈북난민 문제를 다루겠다는 러시아 정부의 입장을 환영한다. 주지하다시피 중국의 경우, 자국내 탈북자들에 대한 조직적인 검거와 강제북송 조치 등으로 국제사회의 비난을 받아왔다. 러시아가 중국의 사례를 따르지 않고 국제사회 규범에 동참하겠다는 의지를 밝힌 것에 경의를 표하고 싶다.

앞서 지난 18일(현지시간) UN본부에서는 북한의 인권 상황을 국제형사재판소(ICC)에 회부해야 한다는 유엔 북한인권결의안이 유엔총회 제3위원회를 통과했다. 오는 12월로 예정된 유엔총회 본회의에서의 통과도 확실시되고 있다.

본의원은 북한인권 문제를 해결하기 위한 국제사회의 정당한 노력에 러시아 정부도 동참할 것을 기대하며, 오는 UN총회 본회의와 UN안보리에서 러시아가 현명한 판단을 내려줄 것을 희망한다. /하태경 새누리당 의원

Thank you for your inquiry. Upon the topic mentioned the Embassy of the Russian Federation in the Republic of Korea would like to inform of the following.
The Government of the Russian Federation has decided upon signing the Agreement, coordinated with the North Korean side, for admission and transfer of the individuals, who violated the countries' legislature for entry, exit and stay of foreign citizens. However, the date of signing the Agreement has not been decided yet. Also, the mentioned document was drafted after standard agreements for the same matter.
The Embassy would like to mention that for the past several years there have been no cases of transferring North Korean refugees to the DPRK from the territory of the Russian Federation. According to the standard procedures, all the requests from North Korean citizens, if any, to the Russian government to be transferred to the third countries are settled in the spirit of humanity, respect for human rights and in close cooperation with the Representation of the United Nations High Commissioner for Refugees in the Russian Federation.
